Summary

This Credit Profile Authorization Agreement acknowledges your permission for Fortify Education, Inc. (“Fortify”) to obtain your credit report and other information from consumer reporting agencies and other third-party information providers. As described below, we may use this information to process your financing application through Fortify, verify information you provide to us, assist with underwriting and credit decisioning, service your loan, facilitate the sale or transfer of your loan or related interests, furnish information to consumer reporting agencies as permitted by law, and provide information to service providers, investors, purchasers, counterparties, or other parties involved in the administration, servicing, funding, monitoring, analysis, purchase, sale, or securitization of your loan. You should carefully read this agreement in its entirety.

REQUIREMENTS

In this Credit Profile Authorization (“Authorization”), the words “you” and “your” mean any user or person authorizing us to obtain and use such person’s consumer reports and related information as described below. The words “we,” “us,” and “our” mean Fortify Education, Inc. (“Fortify”), its service providers (“Service Providers”), servicers, agents, affiliates, partners, investors, purchasers, counterparties, successors, assigns, and any current or future holders of your loan or interests associated with your loan (“Investors”).

Pursuant to this Authorization, you consent to Fortify, its Service Providers, Investors, servicers, and any subsequent holders or purchasers of your loan obtaining, using, reviewing, analyzing, and sharing your consumer reports and related information for any lawful purpose, including but not limited to: (1) authenticating your identity; (2) verifying information provided in your application; (3) making credit, underwriting, prequalification, or financing decisions; (4) assisting with internal modeling, portfolio analysis, risk assessment, and analytics; (5) servicing, monitoring, collecting, or administering your loan; (6) furnishing information regarding your application, loan, payment history, account performance, and repayment status to consumer reporting agencies and other parties as permitted by applicable law; and (7) facilitating the sale, transfer, participation, securitization, pledge, financing, or servicing of your loan or interests associated with your loan (or portions thereof) to third-party investors, purchasers, or counterparties, and for related purposes.

In connection with these purposes, you authorize Fortify to share all or parts of your consumer reports, application information, related credit attributes, and other information provided by you or obtained about you with agents, partners, counterparties, affiliates, Service Providers, purchasers, servicers, or Investors for lawful business purposes related to your application or loan.

If you apply for a loan through Fortify, you may see a “soft” inquiry placed on your credit report by Fortify. Soft inquiries are only visible to you and do not impact your credit score.

You direct Fortify to provide certain elements of your application, as well as consumer report information and related credit attributes, to Service Providers or Investors to use such information for purposes including: (1) making decisions whether to commit funds to purchase your loan and/or securities or other interests associated with your loan (or portions thereof); (2) reviewing, analyzing, underwriting, servicing, monitoring, or evaluating your loan; (3) facilitating the sale, transfer, participation, securitization, financing, or servicing of your loan; or (4) related lawful business purposes. Such decisions, in turn, may assist Fortify in making decisions related to your loan.

You also authorize Fortify to provide such information to Investors in connection with the sale or resale of your loan and securities or other interests associated with your loan (or portions thereof). You further authorize Investors, purchasers, servicers, and Service Providers to share with Fortify your consumer report and other information they may separately obtain about you.

You also authorize us to verify information in your application, and you agree that we may contact third parties, including employers, financial institutions, references, consumer reporting agencies, and other information providers, to verify any such information.

You authorize and agree that Fortify, its Service Providers, Investors, servicers, and any subsequent holders or purchasers of your loan may furnish information regarding your application, loan, payment history, account performance, repayment status, and account activity to consumer reporting agencies and other parties as permitted by applicable law.

You authorize and agree that we may transfer or otherwise provide your credit report or any information contained therein to any successor-in-interest or any purchaser, assignee, investor, participant, counterparty, or servicer of your loan, whether in whole or in part, in connection with lawful business purposes related to your application or loan.

CONSENT

You understand and agree that you are providing written instructions to Fortify Education, Inc. (“Fortify”) under the Fair Credit Reporting Act (“FCRA”) to obtain information from your personal credit profile and other information from one or more consumer reporting agencies, including Equifax, Experian, and TransUnion.

You authorize Fortify, its Service Providers, Investors, servicers, purchasers, and any subsequent holders of your loan to obtain, use, review, analyze, share, and furnish such information in connection with your application, prequalification, credit review, underwriting, account review, servicing, collection, sale, transfer, participation, securitization, financing, or other lawful purposes related to your application or loan.

By checking the box displayed in connection with this Authorization and proceeding with your application, you acknowledge and agree that Fortify may initiate a “soft pull” of your credit, which will not affect your credit score.

By selecting the checkbox displayed in connection with acknowledging and/or agreeing to this Authorization (or by otherwise taking an affirmative action indicating your agreement to this Authorization), you further acknowledge and agree that:

·      You have received, read, and agree to all terms of this Authorization;

·      You authorize Fortify, its Service Providers, Investors, servicers, purchasers, and any subsequent holders of your loan to obtain and use consumer reports and related information about you from one or more consumer reporting agencies, now and periodically thereafter, in connection with your application, prequalification, underwriting, account review, servicing, collection, sale, transfer, or other lawful purposes related to your application or loan; and

·      Your electronic consent, acknowledgment, and agreement shall have the same legal effect as a physical signature.
