In this Consent to Electronic Communications, the word “User” means each person receiving these disclosures. The word "Fortify" means Fortify Education, Inc., its successors, assigns, agents, representatives, and service providers.

By clicking the “Create account” or "Login with existing account" button on our website when a prospective user registers for the service and begins their application for financing, each user (“User”) agrees to receive Communications from Fortify in electronic form, and pursuant to the conditions outlined in this disclosure. “Communications” include account notifications, disclosures (including disclosures required by federal or state law), notices, documents, policies, statements, and all other information and communications originating from Fortify. 

Users may choose not to consent, but they may not be able to use all Fortify services, such as applying for a loan or finalizing a loan from Fortify. If a User consents, Fortify will send Communications electronically where possible. 

REQUIREMENTS

To receive Communications electronically and access services offered by Fortify, User will need:

  • A functioning personal computer, laptop, smart phone, tablet, or other electronic device with an Internet connection (“Device”). The Device must run one of the following operating systems:  Windows 7 (NT 6.1) or higher; Apple macOS X 10.13 (High Sierra) or higher; iOS 13.5.1 or higher; Android 8.0 (Oreo) or higher; or Linux Ubuntu 16.04 LTS or higher.

  • An e-mail account with at least 500 MB of available (unused) storage space and the ability to display HTML content, to which Fortify will send communications.

  • A current web browser that supports 128-bit encryption (e.g. Microsoft Edge 44.19041, Microsoft Edge 83.0.478.54, Mozilla Firefox 76.0 and above, Google Chrome 90.0.4430 and above, or Safari 13 and above) with cookies and JavaScript enabled.

  • A current version of a software program that accurately reads and displays PDF files, such as Adobe Acrobat Reader 15 or higher.

  • Capability to view SMS messages. In order to access, view, and retain SMS Notifications that Fortify makes available to a User, the User must have: (i) a SMS-capable mobile phone, (ii) an active mobile phone account with a communication service provider; and (iii) sufficient storage capacity on User's mobile phone.

In order to retain and/or print electronic Communications, User's Device will need to be able to save and store Communications and/or User will need a working printer connected to their device.  If the hardware and software required to receive Communications ever changes in a way that creates material risk that User will not be able to access or retain Communications, Fortify will provide User notice of any change and an opportunity to withdraw consent, as required by law.

WITHDRAWAL OF CONSENT

User may withdraw User's consent to receiving Communications electronically by emailing Fortify at help@fortifyedu.com. If User withdraws such consent, Fortify will continue providing required disclosures in paper form at no cost to me, except that Fortify may, to the extent allowed by applicable law, provide User with notice and terminate User's relationship with Fortify.

Withdrawal of consent will not affect the legal effectiveness, validity, or enforceability of Communications already provided electronically.

User may also request paper copies of any disclosure or communication at no cost by emailing Fortify at help@fortifyedu.com.

UPDATING CONTACT INFORMATION

User agrees to notify Fortify immediately of any change in the e-mail address or mobile telephone number User provided to Fortify by emailing Fortify at help@fortifyedu.com or by writing to Fortify at 1606 Headway Cir, STE 9411, Austin TX 78754.

CONSENT TO CONTACT

User expressly gives permission to Fortify to provide electronic and other Communications to User, and to contact User at any telephone number (including any wireless or mobile number) or e-mail address that User provided or may provide in the future, according to the following terms:

  • Purpose. User agrees that Fortify may contact User about any matter relating to User's registration with Fortify, User's submission of an inquiry for any Fortify product or service, User's active loan agreements with Fortify, and for any purpose arising out of or in connection with any account User may obtain from Fortify. Fortify may contact User for any purpose related to any account User has, such as reminders or suspicious activity.

  • Agents. User agrees that Fortify may use agents or representatives to contact User on our behalf.

  • Phone, SMS, Autodialers. User agrees that Fortify may contact User through any means, including live agents, emails, telephone, SMS messages (including text messages), calls using pre-recorded messages or artificial voice, and calls and messages delivered using automatic telephone dialing systems (auto-dialer) or an automatic texting system. Automated messages may be played when the telephone is answered, whether by User or someone else. Fortify and its agent or representative may leave messages on User's answering machine, voice mail, or send messages via text. FORTIFY MAY USE ANY MEANS OF COMMUNICATION DESCRIBED IN THIS CONSENT TO CONTACT USER, EVEN IF USER WILL INCUR COSTS TO RECEIVE SUCH PHONE MESSAGES, TEXT MESSAGES, E-MAILS OR OTHER MEANS. User is responsible for any and all charges, including but not limited to, fees associated with text messaging, imposed by User's communications service provider. Please consult User's mobile service carrier’s pricing plan to determine the charges for sending and receiving text messages. These charges will appear on User's phone bill. Message frequency depends on account status or settings.

  • Accurate numbers. User certifies that telephone numbers that User has provided to Fortify are User's contact numbers, and that User is permitted to receive calls at each of the telephone numbers User has provided to Fortify. User agrees to promptly alert Fortify if User ceases to use any such number.

  • Recorded lines. User agrees that Fortify and our agents, representatives, affiliates or anyone calling on our behalf may contact User on a recorded line.

  • SMS Opt Out. User may opt out of SMS messages by replying STOP to any text message received. If User opts out of SMS messages, Fortify may still contact User through other permitted means.

  • SMS Notifications. All SMS Notifications in electronic format from Fortify to the User will be considered to be in writing.
